Terms of Service
Heirloom Haven Studio

Welcome to Heirloom Haven Studio. By placing an order, submitting a photo, using our website, or communicating with us about a portrait, you agree to these Terms of Service. Please review them carefully before ordering.
1. Custom Portrait Services
Heirloom Haven Studio creates custom digital portrait artwork using customer-submitted photos, traits, memories, stories, and selected Truth Statement™ wording. Each order includes one final high-resolution digital portrait file in PNG format. Heirloom Haven Studio provides digital portrait files only and does not sell, produce, ship, or fulfill physical products.
Each portrait is personalized through The Heirloom Truth Method™, which may include:
• 
Customer-submitted traits
• 
Optional memories or stories
• 
Three Truth Statement™ options
• 
Customer selection of a final Truth Statement™
• 
Custom portrait creation
• 
Customer review or approval when applicable
• 
Digital delivery of the final portrait file
2. Customer Responsibilities and Permission to Submit Materials
By submitting materials to Heirloom Haven Studio, you confirm that:
• 
You have the right, permission, or authority to submit the photo, name, story, traits, memories, and personal details provided.
• 
You are authorized to request a portrait of the person shown or described.
• 
The information provided is accurate to the best of your knowledge.
• 
The materials submitted do not violate another person’s privacy, publicity rights, intellectual property rights, or other legal rights.
• 
You will not submit unlawful, harmful, abusive, exploitative, hateful, misleading, or unauthorized content.
• 
You are responsible for reviewing names, spelling, Truth Statement™ wording, and portrait details before approval or final delivery.
For portraits of children, submissions must be made by a parent, guardian, or authorized adult. For memorial portraits or portraits involving another person, you confirm that you have appropriate permission or authority to share the submitted materials for the requested portrait experience.
3. Photo Quality
Portrait quality depends on the quality of the submitted photo. Clear, well-lit photos with the subject’s face visible produce the best results. If a photo is not suitable for portrait creation, Heirloom Haven Studio may request a replacement image.
If a suitable photo cannot be provided before portrait creation begins, the customer may cancel for a refund according to the Refund Policy. If a customer chooses to proceed with a lower-quality image, the final portrait may be limited by the source photo provided.
4. Creative Interpretation
Heirloom Haven Studio portraits are artistic interpretations, not exact photographic reproductions. Final artwork may include painterly refinement, lighting adjustments, background styling, typography, the customer’s selected background palette, and other artistic decisions consistent with the selected collection style.
The studio works to honor the subject’s likeness, character, and story, but final results may vary based on the submitted photo, customer-provided details, selected collection, selected background palette, and the nature of custom creative work. A selected background palette communicates the overall color direction rather than an exact color match. Heirloom Haven Studio may adjust tone, warmth, saturation, contrast, and color placement to preserve likeness and create a cohesive portrait. Customer approval of a portrait direction, Truth Statement™, preview, review copy, or final proof confirms acceptance of the overall creative presentation.
5. Truth Statement™ Wording
Truth Statement™ options are created based on the traits, memories, and story details provided by the customer. The customer is responsible for reviewing and selecting the final Truth Statement™ before portrait completion or final approval.
Heirloom Haven Studio may refine wording for clarity, dignity, tone, grammar, length, and brand consistency. Truth Statement™ wording is intended as an artistic and commemorative expression, not a factual biography, counseling service, psychological assessment, religious statement, or legal declaration.
6. AI-Assisted Creative Process
Heirloom Haven Studio may use AI-assisted tools as part of the creative process for portrait artwork, Truth Statement™ development, and design refinement. AI-assisted tools are used as part of the studio’s creative workflow, but final selections, refinements, presentation decisions, and customer-facing materials remain part of the Heirloom Haven Studio process.
Because AI-assisted and creative tools may produce variations, exact reproduction of any draft, preview, prompt result, or prior sample is not guaranteed.
7. Payment, Taxes, and Order Activation
Portrait creation begins after payment is received and the necessary customer materials have been submitted. Orders are not considered active until payment has been completed and required intake information has been received.
Prices are listed in U.S. dollars unless otherwise stated. Applicable taxes, processing fees, or other checkout charges may be added at checkout when required. Payment information is processed through secure third-party payment providers. Heirloom Haven Studio does not directly store full credit card numbers or sensitive payment details.
8. Delivery Timeline
Most digital portrait orders are delivered within 2 business days after payment is received and all necessary customer materials have been submitted. Business days exclude weekends and holidays.
Delivery timelines are estimates and may vary. Delays may occur if:
• 
A replacement photo is needed
• 
Required information is missing
• 
Customer response or approval is delayed
• 
Additional revision time is needed
• 
Technical, platform, or digital file-delivery issues occur
Heirloom Haven Studio will make reasonable efforts to communicate meaningful delays that affect an active order.
9. Customer Review, Approval, and Inactive Orders
When a customer review, proof, or approval step is provided, the customer is responsible for responding in a timely manner. Approval may be required before final digital delivery.
If a customer does not respond to a review, proof, revision request, or approval request, the order may be placed on hold or marked inactive. Inactive orders may require reactivation before work continues. Heirloom Haven Studio may set reasonable response deadlines to keep production moving and protect studio capacity.
Once a customer approves a final portrait for digital delivery, additional changes may require a new order or additional fee.
10. Revisions
Each portrait includes up to two complimentary revision rounds, unless otherwise stated in the product description or order agreement.
Complimentary revisions may include reasonable adjustments such as:
• 
Minor portrait refinements
• 
Name or spelling corrections
• 
Truth Statement™ corrections or minor wording refinement
• 
Typography placement adjustments
• 
Small visual refinements within the selected collection style
Major changes may require a new order or additional fee, including:
• 
A new subject
• 
A new source photo after portrait creation has begun
• 
A new collection style, background palette, or substantially different portrait direction after portrait creation has begun
• 
A restart of the portrait from the beginning
• 
Substantial changes to the Truth Statement™ after portrait design has begun
• 
Requests outside the original order scope
Revisions are intended to refine the existing portrait, not restart the project from the beginning.
11. Refunds and Cancellations
Refunds are governed by the Heirloom Haven Studio Refund Policy. In general:
• 
Digital portrait orders may be canceled for a full refund within 24 hours of purchase, as long as portrait creation has not yet begun.
• 
Once portrait creation has begun, digital portrait orders are considered custom work and are not refundable.
• 
Once the final digital portrait has been delivered, digital portrait orders are non-refundable.
• 
Approved portraits, customer-submitted errors, or preference changes after approval may not qualify for a refund or complimentary revision.
Any taxes or payment processing fees that are not recoverable by Heirloom Haven Studio may be excluded from a refund when allowed by law and payment provider rules.
12. Digital Files, Personal Use, and Third-Party Printing
Final digital portraits are provided for personal display, personal gift, and personal printing use. Watermarked previews, drafts, proofs, or review copies are not final delivery files and may not be printed, sold, edited, publicly posted as final artwork, or used for commercial purposes.
Customers may use final delivered portrait files to:
• 
Print the portrait for personal use
• 
Display the portrait in their home
• 
Share the portrait with family and friends
• 
Use the portrait as a personal gift
• 
Post the final portrait on personal social media, unless otherwise restricted
Heirloom Haven Studio does not provide physical printing, shipping, framing, or fulfillment. Customers may choose to have the final digital portrait printed by a third-party provider for personal use.
Any printer or printing resource identified by Heirloom Haven Studio is offered only as a general recommendation. The customer contracts directly with the provider and is responsible for reviewing the provider’s pricing, file requirements, specifications, policies, cropping, color, materials, shipping, and final output. Heirloom Haven Studio does not control and is not responsible for third-party print quality, color variation, cropping, damage, delay, loss, or other fulfillment issues.
Customers may not:
• 
Resell the artwork or digital file
• 
Claim the artwork as their own original creation
• 
Use the artwork for commercial products, advertising, branding, merchandise, or resale
• 
Edit, alter, or remove Heirloom Haven Studio branding when branding is included
• 
Use a watermarked preview or proof as a final file
• 
Use the artwork in a misleading, unlawful, harmful, or exploitative way
13. Intellectual Property
Heirloom Haven Studio retains its rights in its brand elements, trademarks, service marks, collection concepts, The Heirloom Truth Method™, Truth Statement™ formatting, design systems, templates, prompts, written materials, website content, and studio-created presentation choices to the extent permitted by law.
Customers receive personal use rights to the final delivered portrait, but do not receive ownership of Heirloom Haven Studio’s underlying methods, templates, prompts, brand assets, design systems, or business materials. Nothing in these Terms transfers ownership of Heirloom Haven Studio’s name, logo, trademarks, service marks, website copy, collection names, or proprietary studio process.
14. Public Display, Testimonials, and Marketing Use
Heirloom Haven Studio does not publicly display customer portraits, names, photos, Truth Statements™, or story excerpts without permission.
For Founding Gallery Families, portfolio examples, testimonials, or marketing use, display permission is requested separately. Customers may choose display preferences such as:
• 
Full name
• 
First name only
• 
Initials only
• 
Anonymous display
• 
No display permission
Customers may update or withdraw display permission by contacting Heirloom Haven Studio. If permission is withdrawn after a portrait or related material has already been displayed, Heirloom Haven Studio will make reasonable efforts to remove it from active studio-controlled websites, social media, or marketing materials going forward.
Complimentary, discounted, promotional, or Founding Gallery portraits may be identified as such when used with testimonials, reviews, portfolio examples, or marketing materials, when disclosure is appropriate.
15. Privacy
Customer information, photos, stories, traits, memories, and portrait details are handled according to the Heirloom Haven Studio Privacy Policy.
16. Refusal, Cancellation, or Decline of Service
Heirloom Haven Studio may decline, cancel, or refund an order if submitted materials are unlawful, abusive, exploitative, hateful, misleading, unauthorized, violate the rights of others, or are inconsistent with the studio’s values and service standards.
Heirloom Haven Studio may also decline or cancel an order if the studio determines that the portrait cannot be completed respectfully, accurately, safely, or within studio standards. If an order is declined before portrait creation begins, a refund may be issued. If work has already begun, refund eligibility will depend on the stage of production, the nature of the issue, and the Refund Policy.
17. Website Use and Third-Party Services
Heirloom Haven Studio may rely on third-party services for website hosting, payment processing, email communication, file storage, design tools, AI-assisted creative tools, analytics, and digital file delivery. Heirloom Haven Studio is not responsible for the independent actions, outages, policies, or delays of third-party providers, but will use reasonable care in selecting services that support the studio’s operations.
Customers agree not to misuse the website, interfere with website operation, attempt unauthorized access, submit malicious code, or use the website or services for unlawful purposes.
18. Limitation of Liability
To the fullest extent allowed by law, Heirloom Haven Studio is not liable for indirect, incidental, emotional, reputational, special, punitive, or consequential damages related to use of the website, portrait services, digital files, delivery delays, customer-submitted materials, creative interpretation, customer-selected third-party printing services, or other third-party service providers.
The maximum liability for any order is limited to the amount paid for that order. Nothing in these Terms is intended to limit rights that cannot legally be limited under applicable law.
19. Governing Law
These Terms of Service are governed by the laws of the State of Washington, without regard to conflict-of-law principles.
20. Updates to These Terms
Heirloom Haven Studio may update these Terms of Service from time to time. The most recent version will be posted on the Heirloom Haven Studio website. Continued use of the website or studio services after updates are posted means you agree to the updated Terms.
